Rental Agreement
YOURVILLA RENTAL AGREEMENT
Hereinafter, the tenant renting the villa shall be referred to as 'Tenant', and the villa lessor shall be referred to as 'YourVilla'.
This agreement is made for the rental of any apartment or villa listed on the website www.YourVilla.com.tr for a predetermined period between the Tenant and YourVilla.
By sending a request to the relevant villa or apartment through 'www.YourVilla.com.tr' or our website, along with payment of the advance payment and completion of the reservation, the Tenant and accompanying parties agree to the following conditions in advance. Any violation of the following terms entitles YourVilla to unilaterally cancel the reservation, demand the Tenant to vacate the villa, and retain the payment.
Tenants may not transfer their rights and obligations arising from this agreement to third parties without the approval of YourVilla; YourVilla may transfer its rights and obligations arising from this agreement to third parties.
For the reservation to be confirmed, 30% of the total rental fee is taken as an advance payment. After the advance payment is made, reservation information is sent to the Tenant via email. By making the advance payment, the Tenant agrees to the terms and conditions of this agreement. The Tenant is responsible for paying the remaining amount upon entering the relevant villa.
If the Tenant wishes to check out for any reason after check-in or checks out, no refund will be made.
YourVilla issues a brokerage invoice for mediating between the Tenant and the villa/apartment owner regarding the rental.
There is no refund for the advance payment made for the reservation.
In case of cancellations made 60 days or more before the scheduled reservation date, 50% of the total amount is charged; cancellations made between 60 and 31 days before the reservation date will be charged 70% of the total amount; cancellations made 30 days or less before the reservation date or in case of no-show, the full amount will be charged.
If the reservation date needs to be changed, it can be changed for an additional fee of 250 TL if accepted by the villa/apartment owner acting as an intermediary; however, the selected villa/apartment cannot be changed.
If the reservation is canceled by the villa/apartment owner or YourVilla, YourVilla is obliged to refund the full advance payment made by the Tenant.
YourVilla is an internet site that acts as an intermediary between villa/apartment owners and Tenants, and does not accept responsibility for any incidents (accidents, illnesses, fires, thefts, deaths, drownings, trips, shopping, food, entertainment, transportation, travel, power outages) that may occur related to the rented villa/apartment; all responsibility lies with the villa/apartment owner. YourVilla is responsible for promptly forwarding any complaints from the Tenant to the relevant individuals.
Additional charges are not required for pool and garden cleaning, electricity, water, internet, etc.
In order for the responsible personnel to perform periodic maintenance for pool maintenance, they must enter the necessary areas and be present in those areas.
Entry cleaning is included in the price for daily, weekly, and monthly rentals; for rentals longer than one week, weekly cleaning is included in the price; extra cleaning or sheet change is subject to a fee.
Due to the special requests of some villa or apartment owners, a cleaning fee may be requested for reservations of less than one week, or rentals for less than a week may not be allowed.
The temperature of heated pools varies between 20 degrees Celsius and 29 degrees Celsius. YourVilla is not responsible if the pool does not heat up due to a power outage.
YourVilla is not responsible for illnesses and allergies caused by water from the swimming pool and shower of the rented property.
YourVilla is not responsible for animals, pests, insects, and odors from manure found in or around the rented apartment/villa. Such situations may occur in villas located in nature.
A security deposit ranging from 1000 TL to 7000 TL is taken at check-in; it is refunded upon check-out if no damage occurs and the house is left in a clean condition; if damage is detected upon check-out, the damage is deducted from the deposit and the remaining amount is refunded to the Tenant; if the deposit is insufficient to cover the damage, the remaining amount is collected from the Tenant in cash at that time.
The number of persons staying in the villa or apartment cannot exceed the capacity specified on our website's detail page; if there are more persons than the specified number, the villa/apartment owner has the right to ask these persons to leave or request an additional fee. Every child over the age of 2 is included in the number of persons staying, and the number is calculated accordingly.
Pets and smoking are not allowed inside the rented property.
The earliest check-in time for the villa is 16:00, and the latest check-out time is 10:00.
Tenants are advised to take out personal insurance for life, health, theft, and travel.
If Tenants engage in behavior that disturbs the environment or constitutes a crime during the rental period, YourVilla has the right to cancel the Tenant's reservation, and no refund will be made.
No 100% guarantee is given for villas in the Conservative (not visible from the outside) category to remain invisible from the outside, and YourVilla does not accept responsibility for any situations that may arise.
YourVilla does not share Tenants' personal information such as name, surname, address, phone number, email address with third parties; this information is used for statistical purposes and campaign notifications. YourVilla is not responsible if this data falls into the hands of third parties due to cyber-attacks.
It is the Tenant's responsibility to access the rented apartment or villa.
YourVilla is not responsible for dissatisfaction and problems arising from the road, geographical location, decoration, and materials used in the rented villa/apartment.
The geographical location data provided by YourVilla are approximate.
YourVilla is not responsible for accidents, problems, deaths resulting from accidents or health problems such as insect bites, poisoning, allergies arising from the construction of the property or the facilities it offers.
YourVilla is not responsible for problems such as insects and pests that may arise in the villa/apartment options offered in nature.
Changes to the color, size, or some decorative items in the pictures on the YourVilla website do not constitute grounds for reservation cancellation.
In case of reservation cancellations resulting from unforeseeable events such as social and societal events or individual force majeure events (threat of war, terrorist activities, natural disasters, health risks, pandemic, or the death of a first-degree relative), a refund will be made.
Rental conditions apply in cases of cancellation of leave by public or private company employees.
In case of irreparable damage caused by the rented property, payment is made based on the number of days not stayed, and the rental fee for the days stayed is not refunded.
The Tenant must check in and make the remaining payment on the date committed to the rented apartment or villa; if the Tenant wishes to check-in on a different date during the reservation period, the Tenant is obliged to pay the full remaining reservation fee on the original start date of the reservation. If payment is not made, YourVilla has the right to resort to legal action.
In accordance with Article 15/g of the Regulation on Distance Contracts of the Ministry of Industry and Commerce dated 27.11.2014 and published in the Official Gazette No. 29188, the Tenant cannot exercise the right of withdrawal in any way.
By accepting this agreement, the Tenant who made a reservation for any villa or apartment is deemed to have read and accepted the above terms and conditions in full. Any behavior contrary to these terms and conditions entitles YourVilla to unilaterally cancel the reservation, retain the full payment, and demand the full amount.
Severability: If any provision or part of a provision of the Agreement is found to be or becomes legally invalid, and it is determined that the other provisions of the Agreement are capable of being implemented without such provision or part, this shall apply only to the said provision or part, and the validity or enforceability of the other provisions of the Agreement shall not be affected.
By accepting this agreement, the Tenant is also deemed to have accepted the 'Privacy and Security Policy'.
In case of any disputes related to this agreement, the Kas Execution Offices and Courts are authorized.
